President Trump says U.S. must be ‘well compensated’ in TikTok deal

President Trump again called for a payment to the U.S. Treasury as part of a deal with TikTok.

Speaking to reporters outside Air Force One before flying to Kenosha, Wisc. on Tuesday, Trump said the U.S. “has to be compensated, well compensated.”

Trump continues to say the federal government should be paid, though The New York Times reported last month that “no one knows how that’d work.”

Trump is threatening to ban TikTok in the U.S., citing suspicions that its parent company ByteDance is sharing user data with the Chinese government. The Trump administration has set a Sept. 15 deadline for reaching an agreement to continue TikTok’s U.S. operations. Microsoft, Walmart, Oracle, and others are all potential buyers. The reported purchase price is between $20 billion and $30 billion.

The Wall Street Journal reported Tuesday that China’s new export restrictions on AI technology could pose a roadblock on a potential deal, with the app’s core algorithms in question.

TikTok sues U.S. government, ramping up battle with Trump administration amid acquisition talks

TikTok on Monday sued the U.S. government over President Trump’s executive order that demands the app’s owner, China-based ByteDance, to sell off or spin out its TikTok business in the U.S. within 90 days.

The lawsuit is not expected to directly impact deal negotiations, Axios reported. Microsoft and Oracle are in talks to buy the popular social video app’s operations in the U.S., Canada, Australia, and New Zealand.

TikTok claims that it was deprived of due process.

“We strongly disagree with the Administration’s position that TikTok is a national security threat and we have articulated these objections previously,” TikTok said in a statement.

Trump issues executive order banning transactions with TikTok parent ByteDance in 45 days

President Donald Trump signed an executive order Thursday blocking all transactions with ByteDance, the China-based company that owns TikTok, in 45 days.

Trump cited a “national emergency with respect to the information and communications technology and services supply chain” as the reason for the moratorium, escalating a dispute with TikTok that could force an acquisition of some or all of the social app by Microsoft or another company.

Trump initially announced his intention to ban TikTok last week but backed off of the plan after speaking with Microsoft CEO Satya Nadella about the American software giant’s plan to acquire TikTok’s business in the U.S. and a handful of other countries. Nadella and Trump agreed that acquisition talks would conclude by Sept. 15.

The new executive order, set to take place five days after that deadline, adds pressure to the negotiation talks. It also indicates that the president, who does not always follow through on bold propositions, means business.

The unusual executive order will almost certainly face legal challenges, however.

Trump also signed an executive order related to WeChat, owned by China-based tech giant Tencent.

Initially, Microsoft expressed an interest in taking over the app in the U.S., Canada, New Zealand, and Australia but The Financial Times reported Thursday that the company has discussed the possibility of buying TikTok’s business in Europe and India as well.

Microsoft has acknowledged Trump’s concerns that ByteDance could be sharing information about users with the Chinese government, and said it would address the issue as part of the process. ByteDance and TikTok have denied the allegations.

Mergers and acquisition experts are debating TikTok’s price tag, estimating it could sell for anywhere from $10 billion to $50 billion.

Microsoft is well-positioned to pay top dollar for the coveted app. Its market value is at $1.6 trillion, and its cash, short-term investments stood at $136 billion as of June 30. The company’s largest acquisition to date was the $26.2 billion purchase of professional social media network LinkedIn in 2016.

Microsoft’s careful Trump strategy could land it two huge prizes this summer — and draw scrutiny

Microsoft president Brad Smith once described the delicate “balance that we try to strike” when working with the Trump administration. He was referring to the tightrope act of partnering with the federal government one day, and suing it the next, during a Town Hall event in Seattle that I moderated last year.

“Politics is often about pragmatism and not principle alone,” Smith said during the Seattle event.

And now that pragmatism is on full display as Microsoft — a company best known for enterprise software and cloud computing — weighs the politically-charged purchase of social media giant TikTok.

Perhaps no tech company has navigated the bizarre political landscape of the past four years as deftly as Microsoft. Consider:

It won the lucrative $10 billion Joint Enterprise Defense Infrastructure project from the Pentagon, outfoxing rival Amazon in D.C.It has largely avoided the latest antitrust drama, even though Microsoft’s market value has swelled to more than $1.5 trillion.And most recently it emerged as the surprise bidder for TikTok’s business in the U.S. and other key markets, a wild twist that’s resulted in direct negotiation between Microsoft CEO Satya Nadella and President Donald Trump. (Breaking form with his predecessors, the sitting president is actively intervening in the acquisition deal. He said Monday that the negotiations must be finalized by Sept. 15 and provide “a very substantial portion” of the sale price to the U.S. Treasury).

What’s driving this unusual path for Microsoft? And where will it head next?

Microsoft’s government work stretches back decades, providing the software tools and cloud computing capacity to power everything from law enforcement to transportation infrastructure to court systems. Even while providing those services, Microsoft — largely under the direction of Smith — established a reputation as the tech industry’s moral compass. It was the wise elder among younger upstarts like Facebook or Twitter or even Amazon.

But Microsoft’s amicable relationship with the Trump administration is now raising eyebrows.

Tech journalists and other followers of the industry criticized Microsoft for holding closed-door negotiations with the Trump administration and allowing the federal government to reach so deeply into the TikTok deal.

M.G. Siegler, a former tech reporter and general partner at Google’s VC arm GV, said Microsoft “should be ashamed for playing along with this farce in any way.” He said Microsoft’s blog post on Sunday parroted Trump talking points, calling it a “huge black eye.”

Trump “demanded propaganda in order to win a deal,” Siegler tweeted. “Kiss the ring. Bend the knee.”

Others also sounded off:

The deal is far from a sure thing. Microsoft is negotiating the purchase of TikTok’s service in the U.S., Canada, Australia, and New Zealand, planning to own and operate the service in those markets if it can reach an agreement with ByteDance.

It will be a busy August for Microsoft as it works to close the TikTok deal and awaits the Pentagon’s latest decision in a legal dispute over the Joint Enterprise Defense Infrastructure project. Microsoft beat out rival Amazon and won the $10 billion cloud computing contract, surprising many who saw Amazon as a shoo-in for the project. Amazon sued the federal government, claiming that Trump’s personal animus toward the company improperly impacted the outcome of the contest.

The lawsuit is on hold while the Pentagon reviews aspects of Microsoft and Amazon’s bid. The department plans to “do a re-announcement of our intentions to award,” by the end of August, according to Pentagon CIO Dana Deasy.

Some speculate that by helping the federal government avoid the messy, complicated process of banning a global social media brand, Microsoft could improve its chances for JEDI and other federal contracts.

“Bailing the government out like this probably helps their government contracts on some level,” said former Zillow CEO Spencer Rascoff, speaking with CNBC Tuesday about the potential deal.

If both the JEDI and TikTok deals work out in Microsoft’s favor, the company will gain a major foothold in the federal government’s transition to the cloud and gain the fastest-growing social media platform.

Trump anuncia que prohibirá el uso de TikTok en EEUU y asegura que tiene «autoridad» para ello

El presidente de Estados Unidos, Donald Trump, ha anunciado este viernes que prohibirá el uso de la aplicación TikTok en el país norteamericano, al tiempo que ha asegurado que «tiene autoridad» para ello.

«En lo que respecta a TikTok, lo vamos a prohibir en Estados Unidos», ha señalado Donald Trump a la prensa abordo del Air Force One. Así, ha especificado que para prohibirlo usaría poderes económicos de emergencia o una orden ejecutiva, aunque no ha proporcionado más detalles en este sentido, según informa la cadena de televisión CNN.

Horas antes, se ha referido al asunto y ha confirmado que su Administración estaba considerando la posibilidad de prohibir el uso de la aplicación de telefonía móvil, tras la apertura de una investigación a la ‘app’ por motivos de seguridad nacional.

«Estamos analizando TikTok. Podríamos prohibir TikTok, podríamos hacer otras cosas. Hay un par de opciones, pero muchas cosas están pasando», ha manifestado Donald Trump.

La investigación contra TikTok, propiedad de la china ByteDance, la ha llevado a cabo el Comité de Inversiones Extranjeras de Estados Unidos. Las autoridades estadounidenses estaban preocupadas por si la ‘app’ supone un riesgo a la seguridad nacional.

En concreto, los críticos con la aplicación mostraban su recelo por si los datos que TikTok podría recolectar de los usuarios estadounidenses podrían acabar en manos del Gobierno chino, a pesar de que la compañía ha asegurado que almacena sus datos fuera de China y que se resistiría a cualquier intento de Pekín por apropiarse de la información.

Por su parte, expertos en ciberseguridad han señalado que el potencial riesgo para la seguridad nacional que representa la aplicación es, sobre todo, teórico y que no hay ninguna evidencia que sugiera que los datos de los usuarios de TikTok puedan estar comprometidos por la Inteligencia de China.

Pekín acusó este jueves a Washington de «amenazar sin pruebas a empresas chinas» y de violar con ello «los principios de la Organización Mundial del Comercio (OMC)».

«Sin pruebas, Estados Unidos amenaza a una compañía china a raíz de una presunción de culpabilidad, revelando su hipocresía en el llamado ‘respeto a la justicia y las libertades’», criticó Wang Wenbin, portavoz del Ministerio de Exteriores del gigante asiático.
